Why this is a federal-vs-state preemption fight
Kalshi is a CFTC-registered Designated Contract Market (DCM) — the same federal classification as the CME. Polymarket relaunched in the US in late 2025 after acquiring QCX, also a CFTC-registered exchange. Federal commodities law (the Commodity Exchange Act) generally preempts state attempts to regulate trading on registered exchanges. Kalshi has already won state-court challenges in New Jersey, Nevada, and Massachusetts on similar grounds.

They are CFTC-licensed derivatives exchanges, and courts have repeatedly upheld that distinction.
If the CFTC wins in Minnesota, the ruling will lock in federal preemption nationwide. That is unambiguously good for Florida traders: it would foreclose the kind of state-by-state patchwork that has fragmented sports betting. If the CFTC loses, expect a wave of state-level proposals — but Florida is not currently among the states where one is plausibly on the table.
