    How Federal Law Makes Prediction Markets Legal in FL

    Prediction markets in Florida exist under federal commodities law, not state gambling law. Here's exactly why that matters.

    CFTC Oversight

    The Commodity Futures Trading Commission (CFTC) is the federal agency that regulates US derivatives markets — futures, options, swaps, and event contracts. Exchanges that list event contracts must register as a Designated Contract Market (DCM) and operate under the Commodity Exchange Act. Kalshi has been a registered DCM since 2020. Polymarket's US app operates through its 2025 acquisition of CFTC-regulated QCEX.

    Federal Preemption

    Federally regulated commodities exchanges are governed by the Commodity Exchange Act, which preempts conflicting state law. This is the same principle that allows the Chicago Mercantile Exchange to offer futures contracts nationally without each state needing to license it. Florida cannot prohibit a federally licensed event contract exchange from operating in the state.

    No FL Statute Prohibits Trading

    Florida's gambling statutes (Chapter 849) target unlicensed games of chance, lotteries, and bookmaking. They do not address — and have never been applied to — federally regulated commodity event contracts. The Florida Gaming Control Commission has not issued any cease-and-desist actions against CFTC-regulated event contract exchanges.

    Court-Tested in 2024

    In KalshiEX LLC v. CFTC (D.D.C. 2024), the federal court ruled that the CFTC could not categorically block Kalshi from listing election event contracts. The decision reinforced that event contracts on a registered DCM are lawful federal commodities. Kalshi has since expanded sports and political markets nationwide, including in Florida.
