    Polymarket is legal in Florida. In July 2025 the company acquired QCX LLC, a small but fully regulated Designated Contract Market (DCM) and clearinghouse already licensed by the U.S. Commodity Futures Trading Commission, for a reported $112 million. That deal — and the CFTC's subsequent green light — is what brought Polymarket back to U.S. users after the 2022 settlement that pushed it offshore.

    Because Polymarket US now operates as a CFTC-registered futures exchange (the same federal classification as the CME or ICE), it sits under the Commodity Exchange Act rather than under state gambling law. The legality conversation in Florida — or any other state — is no longer about whether residents can use it. It's about which federal rules govern which contracts.

    Why state law doesn't apply

    Section 2(a)(1)(A) of the Commodity Exchange Act gives the CFTC exclusive jurisdiction over derivatives traded on a Designated Contract Market. When Kalshi tested this in 2024–2025 against New Jersey and Nevada regulators who tried to issue cease-and-desist letters, federal courts repeatedly sided with Kalshi: state gaming statutes were preempted on a CFTC-licensed exchange. Polymarket inherits the same legal posture through QCX.

    Florida has not opened a parallel state-level action against Polymarket as of mid-2026. The state's online sports-wagering arrangement with the Seminole Tribe covers sportsbooks under tribal compact — a different legal product from federally regulated binary event contracts.
