Quick answer

Yes. Polymarket US accepts eligible Florida residents (status: Available, as of 3 October 2026). Its exchange is QCX LLC, a CFTC-designated contract market since 9 July 2025, and Florida has taken no enforcement action against it. Federal derivatives law governs the exchange, so Florida gambling statutes do not apply and residents (minimum age 18; we recommend 21+) can fund an account and trade event contracts. Polymarket US is available in 49 states plus D.C. (not Nevada).

Is Polymarket Legal in Florida? (2026 Update)

Polymarket US accepts eligible Florida residents (status: Available, as of 3 October 2026). In July 2025 the company acquired QCX, a small but fully regulated Designated Contract Market (DCM) and clearinghouse already licensed by the U.S. Commodity Futures Trading Commission, for a reported $112 million. That deal — and the CFTC's subsequent green light — is what brought Polymarket back to U.S. users after the 2022 settlement that pushed it offshore.

Because Polymarket US now operates as a CFTC-registered futures exchange (the same federal classification as the CME or ICE), it sits under the Commodity Exchange Act. Florida residents can use it today, and Florida has taken no action against it. Whether states can still apply their gambling laws to sports contracts is the open question: the federal appeals courts split on it in 2026 at the preliminary stage, and three Supreme Court petitions are pending.

Why state law doesn't apply

Section 2(a)(1)(A) of the Commodity Exchange Act gives the CFTC exclusive jurisdiction over derivatives traded on a Designated Contract Market. Whether that overrides state gambling law for sports contracts is now split: at the preliminary stage the Third Circuit sided with Kalshi against New Jersey (April 6, 2026), while the Ninth Circuit (Nevada, August 28) and Sixth Circuit (Ohio and Tennessee, September 25) sided with the states. Kalshi asked the full Sixth Circuit to rehear the case on October 9, 2026; the court has not ruled. Polymarket US, through QCX, is in a similar position. Three Supreme Court petitions are pending.

Florida has not opened a parallel state-level action against Polymarket as of mid-2026. The state's online sports-wagering arrangement with the Seminole Tribe covers sportsbooks under tribal compact — a different legal product from federally regulated binary event contracts.

  • Age: Polymarket US's minimum age is 18 (we recommend 21+); Florida's 21+ minimum applies to sportsbooks such as Hard Rock Bet.
  • Funding: US dollars in the app. Credit cards are blocked.
  • Taxes: Florida has no state income tax, so net winnings only hit your federal return.

Did Polymarket actually buy a U.S. exchange?
Yes — Polymarket announced the acquisition of QCX (and its sister clearinghouse) for $112 million on July 21, 2025. The CFTC listed QCX d/b/a Polymarket US as a Designated Contract Market on its DCM filings page in July 2025.

Anything explicitly excluded by the market's listing rules — currently this mostly applies to certain election contracts during specific windows. Check the individual market page for its resolution and eligibility rules before trading.
