Bitcoin Betting in 2026: The Legal U.S. Guide
You can legally trade Bitcoin price contracts in the U.S. — including Florida — through CFTC-regulated prediction markets. Here's how the contracts work and what to watch.
- Price ladders — stacked binary contracts at multiple strikes ($110k, $115k, $120k, etc.) resolving on a defined date.
- Daily and weekly settlement windows in addition to monthly and quarterly ladders.
- All-time-high contracts — 'Will BTC set a new all-time high by [date]?'
- Macro adjacents — ETF flow contracts, halving-cycle markets, and BlackRock IBIT / Fidelity FBTC AUM milestones.

You can legally trade Bitcoin price contracts in the United States — including Florida — through CFTC-regulated prediction markets. Polymarket and Kalshi both list binary BTC contracts that pay $1 per share if Bitcoin's reference price closes at or above a defined strike by a deadline. The contracts are settled in cash on a published reference rate; they're not the same as owning spot BTC or trading a perpetual future.
What's actually listed
- •Price ladders — stacked binary contracts at multiple strikes ($110k, $115k, $120k, etc.) resolving on a defined date.
- •Daily and weekly settlement windows in addition to monthly and quarterly ladders.
- •All-time-high contracts — 'Will BTC set a new all-time high by [date]?'
- •Macro adjacents — ETF flow contracts, halving-cycle markets, and BlackRock IBIT / Fidelity FBTC AUM milestones.
Settlement
Most BTC contracts settle on a published reference rate at the resolution timestamp. The CME CF Bitcoin Reference Rate (BRR) is the most commonly cited source for U.S. exchanges; some markets use a different fix. Always read the resolution-source line on the individual market page — the choice of fix can materially change the outcome on a close strike.
Where the trade-offs are
- •Versus spot BTC: a binary contract is a leveraged expression of a single binary view, with capped downside (the price you pay) and capped upside ($1 per share).
- •Versus perpetuals: no funding rate, no liquidation risk — you can only lose what you paid for the share.
- •Versus options: no theta or vega between trade and resolution. The trade-off is you don't capture continuous moves.
Florida-specific notes
BTC contracts on Kalshi and Polymarket US are available to Florida residents. Florida has no state income tax, so the only tax filing is federal. Note that event-contract gains are reported on derivatives-exchange forms, not on the crypto-specific 1099-DA framework — talk to a CPA who has handled both.
